1.About Us
This website is operated by NDSB Pty Ltd trading as Aumoria (ABN: 86 684 110 389), a company registered in Western Australia, Australia. Throughout these Terms, the words "we," "us," and "our" refer to NDSB Pty Ltd trading as Aumoria. The words "you" and "your" refer to the person accessing or using our website and services.
2.Acceptance of Terms
By visiting our website and/or purchasing from us, you confirm that you have read, understood, and agree to be bound by these Terms of Service, including any additional terms, conditions, and policies referenced herein. These Terms apply to all users of the site, including browsers, customers, and contributors of content.
By accepting these Terms and engaging Aumoria to provide our services, you also provide express consent for your content to be shared with the third-party platforms named in our Privacy Policy, solely for the purpose of delivering our services.
Please read these Terms carefully before accessing or using our website. If you do not agree to these Terms, please discontinue use of our website and services immediately.
We reserve the right to update or replace these Terms at any time by posting changes to this page. It is your responsibility to check this page periodically. Your continued use of the website following any changes constitutes acceptance of those changes.
Our store is hosted on Shopify Inc., which provides the e-commerce platform through which we sell our products and services.
3.Eligibility
By agreeing to these Terms, you confirm that you are at least 18 years of age, or that you are the age of majority in your state or territory of residence and have provided consent for any minor dependents to use this site.
You may not use our products or services for any illegal or unauthorised purpose, or in violation of any applicable laws in your jurisdiction.
4.Our Service
Aumoria creates custom hardcover Legacy Books from voice recordings and photographs submitted by customers through our secure online portal. Each Legacy Book is a unique, personalised product made specifically for your family.
Aumoria also sells a range of ready-made physical products, including Journals, Letter Kits, and Gift Sets (together, "Ready-Made Products"). These products are not custom-made and are dispatched as available stock. Different cancellation and refund terms apply to Ready-Made Products, as set out in the Cancellations and Refunds section below.
Our service includes:
- Access to your personal Aumoria portal where you submit voice recordings, photographs, and notes
- Transcription of your voice recordings using automated transcription software, followed by personal review and hand-editing by Aumoria's founder
- Custom design and layout of your Legacy Book
- A two-stage review process: a First Story Check-in and a Final Proof, before printing begins
- Printing and delivery of your finished Legacy Book
The First Story Check-in and Final Proof are your opportunities to review your book and request changes before printing begins. We will do our best to accommodate your feedback at each stage. 5.Your Content
When you submit voice recordings, photographs, written notes, or any other material through your portal ("your content"), you retain full ownership of that content at all times.
By submitting your content to us, you grant NDSB Pty Ltd a limited, worldwide, non-exclusive, royalty-free licence to use, transcribe, edit, reproduce, and sublicense that content solely for the purpose of creating your Legacy Book. Sublicensing is limited to the third-party platforms named in our Privacy Policy and only to the extent necessary to deliver our services. We will not use your content for any other purpose, including marketing, publication, AI training, or sharing with third parties, without your explicit written consent.
You warrant to us that you own, or have the appropriate permissions to share, all content you submit, including voice recordings, photographs, and any other materials. You are responsible for ensuring that any content featuring or relating to other people, including voice recordings and photographs of family members, is shared with their knowledge and consent.
We treat all submitted content with the utmost care and discretion. Please refer to our Privacy Policy for full details of how your content is stored, processed, and deleted.
6.Cancellations and Refunds
Because every Legacy Book is a custom-made product created specifically for your family, our refund and cancellation policy reflects the personalised nature of our work.
Legacy Book cancellations
When you place your order, you'll record one story to start. Nada will edit it by hand and send you a first draft so you can see what your Legacy Book will look and feel like.
You can cancel for a full refund at any point before that draft arrives, whether your loved one decides not to record, the process feels too hard, or you simply change your mind.
You can also cancel after the draft arrives. If it isn't what you hoped for and you'd rather not keep going, email us at nada@aumoria.com and we'll refund you in full.
If you do want to keep going, we'll keep working on it together until you're happy. Your Legacy Book doesn't go to the printer until every page is right and you have approved the Final Proof. Once the Final Proof is approved and printing has begun, the order is no longer cancellable, as production is underway.
Manufacturing defects
Every Legacy Book is personally inspected by us before dispatch. In the unlikely event that a manufacturing defect becomes apparent after delivery, please contact us at nada@aumoria.com. Your rights in relation to manufacturing defects are governed by the Australian Consumer Law, which provides for repair, replacement, or refund depending on the nature of the defect.
Transit damage
If your book arrives with damage sustained in transit, please notify us within 7 days of delivery with photographs of the damage. We will arrange a replacement at no cost to you, prioritised and shipped as quickly as possible.
Two-stage review process
To give you full confidence before printing begins, every Legacy Book goes through a First Story Check-in and a Final Proof. These review stages are your opportunity to ensure the tone, names, layout, and content are exactly as you want them. Printing does not begin until you have approved the Final Proof.
Ready-Made Products: change of mind returns
For Ready-Made Products (Journals, Letter Kits, and Gift Sets), we offer a 30-day change-of-mind return policy. If you are not satisfied with your purchase, you may return it within 30 days of delivery, subject to the following conditions:
- The item must be unused and in its original condition
- Original packaging must be intact
- Proof of purchase is required
- Return postage is at the customer's expense for change-of-mind returns
A full refund will be issued once the returned item has been received and inspected. To initiate a return, please contact us at nada@aumoria.com. Manufacturing defects and transit damage for Ready-Made Products are covered by the same terms as Legacy Books, as set out above.
Your rights under Australian Consumer Law
Nothing in these Terms limits or excludes any rights you have under the Australian Consumer Law, including consumer guarantees that cannot be excluded by contract.
7.Pricing and Payment
Prices are listed in Australian dollars and are subject to change without notice. We reserve the right to modify or discontinue any product or service at any time.
We reserve the right to refuse or cancel any order at our discretion. If we cancel an order before work has commenced, you will be notified and a full refund will be issued. If we cancel an order after work has commenced due to a breach of these Terms by you, we reserve the right to charge for reasonable costs incurred up to the point of cancellation, with any remaining balance refunded.
Payment is processed securely through Shopify's payment system. We do not store your credit card details.
8.Delivery
We will provide estimated delivery timeframes at the time of purchase. Delivery timeframes are estimates only and may vary due to factors outside our control, including printing and postal delays.
If your order is lost or damaged in transit, please contact us at nada@aumoria.com within 7 days of the expected delivery date. We will arrange a replacement at no additional cost, in accordance with our obligations under the Australian Consumer Law.
9.Accuracy of Information
We make every effort to ensure that information on our website is accurate and current. However, we do not warrant that product descriptions, pricing, or other content is complete, accurate, or error-free. We reserve the right to correct any errors or inaccuracies and to update information at any time without prior notice.
10.Prohibited Uses
You may not use our website or services:
- For any unlawful purpose
- To violate any applicable laws or regulations in Australia or your jurisdiction
- To infringe upon the intellectual property rights of others
- To submit false or misleading information
- To upload or transmit viruses or malicious code
- To collect or track the personal information of others without their consent
- To harass, abuse, defame, or discriminate against any person
We reserve the right to terminate your access to our services for any violation of these prohibited uses.
11.Third Party Services
Our website and services make use of third party platforms including Shopify, Airtable, Softr, Klaviyo, Google Workspace, Rev, and Canva. We are not responsible for the privacy practices or terms of these third party services. Information about each platform and their privacy practices is provided in our Privacy Policy. We encourage you to review each provider's privacy policy directly via their respective websites.
12.Disclaimer of Warranties
To the extent permitted by Australian law, our services are provided on an "as is" and "as available" basis without warranties of any kind. We do not guarantee that our website will be uninterrupted, secure, or error-free.
13.Limitation of Liability
To the maximum extent permitted by the Australian Consumer Law and any other applicable laws, NDSB Pty Ltd excludes all liability for any indirect, incidental, special, punitive, or consequential loss or damage, or any loss of profits, revenue, data, or goodwill arising out of or in connection with your use of our services.
To the extent permitted by law, our total aggregate liability for any claim arising out of or relating to these Terms or the services is limited to the amount you paid for the relevant order.
Nothing in these Terms excludes, restricts, or modifies any right or remedy you have under the Australian Consumer Law, including your rights in relation to major failures.
This limitation of liability survives termination of these Terms.
14.Indemnification
You agree to indemnify and hold harmless NDSB Pty Ltd, its officers, employees, contractors, and agents from and against all losses, claims, demands, damages, liabilities, costs, and expenses (including reasonable legal fees on a full indemnity basis) arising out of or in connection with:
- your breach of these Terms;
- your violation of any applicable law;
- your infringement of any third-party rights; or
- any misuse of the services by you.
This indemnity survives termination of these Terms to the extent permitted by Australian law.
15.Governing Law
These Terms are governed by the laws of Western Australia, Australia. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Western Australia.
16.Severability
If any provision of these Terms is found to be unlawful or unenforceable, that provision will be severed and the remaining provisions will continue in full force and effect.
17.Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and NDSB Pty Ltd regarding your use of our website and services.
